24 Hour Fitness Applicant Privacy Notice

This Applicant Privacy Notice (“Privacy Notice”) describes the collection, use, and sharing of your personal information when you apply for a position with 24 Hour Fitness (“24 Hour Fitness”, “us”, “we” or “our”). If you do become an employee with 24 Hour Fitness, your personal information is subject to our Team Member Privacy Policy.

This Privacy Notice does not apply to third party sites or services outside of 24 Hour Fitness’ careers page (“Careers Page”) and application process.

1. Collection and Use of Personal Information

When you apply for a position of employment with 24 Hour Fitness, we collect or receive personal information at various stages in the application process as described below: 

  • Complete an application. When you apply for a position with 24 Hour Fitness, we collect, from you, your identifiers (name, email address, home and mobile telephone number, home address) and your professional or employment information (resume/CV, employment history, educational history, letters of recommendation, and references). We use your identifiers and your professional or employment information to review your background and skills, determine your qualifications for the role you are `applying to, and to confirm information related to your education. For equal employment and affirmative action purposes, you also have the option to provide us with your protected classifications (gender, veteran status, and disability status) and sensitive protected classifications (race, ethnicity). We use this protected classification and sensitive protected classification information for government reporting purposes, to comply with legal requirements, to analyze requested disability accommodations as applicable, and to keep a record of things like accommodations we provided to address your needs.
  • Participate in an in-person interview. When you participate in an on-site interview with 24 Hour Fitness, we will automatically collect video recordings of you captured through our CCTV systems on our premises. We use this information to ensure the security of 24 Hour Fitness’ personnel and property. We retain this information for approximately 30 days.
  • Criminal background check information. When you are extended a conditional offer of employment with 24 Hour Fitness, we collect your criminal background check from reporting agencies (arrests, convictions, pending charges, and other information returned in your criminal background check), to the extent permitted by applicable law. We consider any pending arrests or charges and/or convictions reasonable grounds to conduct an individualized assessment to determine your fitness and suitability to the role for which you have applied. We may consider whether your conviction history has a direct and adverse relationship with the specific job duties for which you have applied; the nature or gravity of the offense or conduct; the time that has passed since the offence or conduct and completion of the sentence; and the nature of the job held or sought. We do not consider other criminal history that did not end in a conviction when making hiring decisions, including juvenile records; convictions that have been sealed, expunged, or dismissed; or referral to or participation in a pre-trial or post-trial diversion program.
  • Information from references. If you voluntarily choose to provide references with your response, we may receive from your references your professional or employment information (confirmation of details on your resume/CV, certifications, qualifications, employment history, educational history, behavior since the conviction or completion of sentence), evidence of rehabilitative efforts (participation in work and educational or rehabilitative programming and other prosocial conduct while incarcerated; confirmation of enrollment or completion treatment or behavioral courses, or community service or engagement with a faith based group since the conviction or completion of sentence), and inferences drawn from your references, such as their thoughts on your behavior, intelligence, abilities, and aptitudes. We use this personal information to conduct an individualized assessment to determine your suitability for the position for which you have applied and whether your references demonstrate rehabilitation or mitigating circumstances.

As part of the job application process, we use software to assess whether our candidates meet eligibility criteria that were determined and decided by our team. We do not implement profiling or automated-decision making in our recruitment process.

Information Collected Automatically by Cookies  

  • When You Visit our Careers Page: In addition to the personal information you provide as part of the application, when you use our Careers Page to look for open positions, we collect automatically via cookies and similar technologies electronic network activity information (Internet Protocol (“IP”) addresses, device identifiers, application identifiers, your interactions with the website such as referring web page, and pages visited on our sites, and information about the platforms, browsers, devices, and computers you use to access the Careers Page, including browser type, city, region, country, language, operating system) via cookies. We use this information to enable site functionality and accessibility, to manage access and provide security, to deliver a personalized online experience, and to provide you information regarding the jobs to which you applied and those that may be of interest to you. We also use cookies and similar technologies to collect your approximate geolocation data (based on your IP address. Third party marketing and analytics cookies may be considered a sale or sharing under the California Privacy Rights Act (“CPRA”). For California residents, to opt out, please visit Do Not Sell or Share My Personal Information. Particular third-party cookies to note on our Careers Page includes Google Analytics.
    • Google Analytics. We use Google Analytics to collect information on your use of our Careers Page for its improvement. To collect this information, Google Analytics installs cookies on your browser or reads cookies that are already there. Google Analytics also receives information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personal information. Google’s ability to use and share information collected by Google Analytics about your visits to our Careers Page or to another application which partners with Google is restricted by the Google Analytics Terms of Use and Privacy Policy. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on, which can be accessed here.
  • When you apply for a job: When you “hit apply now” to apply for a job you are directed to a page provided by our third-party application provider (ADP) that automatically collects electronic network activity information using cookies and online trackers in accordance with its own privacy policy and cookie notice. This includes trackers for the purpose of advertising. The information collected through cookies and similar technologies is managed by ADP and we do not get access to it. To learn more about how ADP collects your information via cookies and similar technologies see ADP’s Cookie Privacy Statement and to opt out of sharing your information via certain cookies please visit ADP’s “Set Your Cookie Preferences” page by going to www.adp.com and selecting “Set Your Preferences” within ADP’s Cookie Banner that pops up automatically at the bottom of your screen.

24 Hour Fitness will use the personal information that we collect as described in this section to determine your eligibility for the position applied for, to comply with the law, to efficiently maintain our business, and for other limited circumstances as described below in HOW WE SHARE YOUR PERSONAL INFORMATION.

Data Retention

We retain each category of personal information identified above for as long as reasonably necessary to achieve the purposes described herein, or any other notice provided at the time of collection, taking into account applicable statutes of limitation and records retention requirements under applicable law, unless otherwise stated above. We may need to use and retain your personal information for longer than the periods indicated above for purposes of: 

  • Compliance with our legal obligations. For example, retaining personal information where we are legally required to do so, e.g. pursuant to a pending or anticipate legal proceedings.
  • Meeting our safety and security commitments. For example, keeping our properties secure and preventing fraud.
  • Exercising or defending legal claims. We also may need to retain personal information for longer than the periods indicated above in order to respond to legal processes or enforceable government requests, including investigation of potential violations.

However, if you are hired, your information will become part of your personnel file and subject to our Team Member Privacy Policy

 

2. How We Share Your Personal Information

General Sharing  

24 Hour Fitness shares applicant personal information in the following instances:

  • Within 24 Hour Fitness: We share applicant personal information among our hiring decision-makers (i.e. human resources department, senior management, hiring managers, legal) for the purposes of assessing applications and making hiring decisions. Access to applicant personal information is limited to those on a need-to-know basis.
  • For legal purposes: We share applicant personal information with third parties, such as legal advisors, law enforcement agencies, or governmental/regulatory bodies in order to protect our legal interests and other rights, protect against fraud or other illegal activities, for risk management purposes, and to comply with legal obligations.
  • During a corporate reorganization: In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, we would share applicant personal information. We will also share applicant personal information if we undergo bankruptcy or liquidation, in the course of such proceedings.

Sharing in the Preceding Twelve (12) Months

For Business Purposes. In the preceding twelve (12) months, 24 Hour Fitness has disclosed the following categories of personal information for a business purpose to the following categories of third parties:

  • We have shared applicant identifiers and professional or employment information and sensitive identifiers (Social Security number, state driver’s license number, state identification number, gender, ethnicity (if provided)) with our background check provider that assist us in the application process.
  • We have disclosed your personal identifiers and internet or other electronic network information to IT support to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair errors that impair functionality.

Sale of Personal Information 

24 Hour Fitness does not sell or share applicant personal information for monetary consideration. However, sharing information through cookies and other technologies by us and our third-party provider on our careers and job application pages may be a sale or sharing under the CPRA. For California residents, to opt out of sharing through certain cookies on the Careers Page, please visit Do Not Sell or Share My Personal Information. To opt out of sharing through certain cookies by ADP on the job application page, please visit ADP’s “Set Your Cookie Preferences” page by going to www.adp.com and selecting “Set Your Preferences” within ADP’s Cookie Banner that pops up automatically at the bottom of your screen. 

3. Rights of California Applicants 

The California Privacy Rights Act, (“CPRA”) entitles California residents to certain rights. To the extent the CPRA applies to our processing of your personal information, you are entitled to the following rights:

  • Right to Access/Know. You have the right to request what personal information we have collected, used, disclosed, and sold about you. Below there are details on how to exercise this right. You may only submit a request for access twice within a twelve-month period.
  • Right to Deletion. You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking to be deleted, we would not be able to delete the information until we are legally permitted to delete it.
  • Right to Opt-Out of Sale/Sharing. You have the right to opt-out of the sale or sharing of your personal information to third parties. 24 Hour Fitness does not have actual knowledge that it sells or shares personal information of minors under the age of sixteen (16) years. Our use of third-party cookies is a sale/sharing under the CPRA. To opt out of the sale or sharing of your personal information via cookies, please visit Do Not Sell or Share My Personal Information
  • Right to Non-Discrimination. You have the right to be free from discriminatory treatment if and when you exercise your rights to access, delete, opt-out, correct, or limit the use of sensitive personal information under the CPRA.
  • Right to Correct: You have the right to correct inaccurate personal information that we collect or maintain. If we believe the information in question is correct in our records, we may ask you to provide documentation, if necessary, to rebut the information we have collected from you.
  • Use of Sensitive Personal Information: We do not collect or process any sensitive personal information for the purpose of inferring characteristics about applicants, nor do we collect or process sensitive personal information to perform services not reasonably expected by an average applicant.

For requests submitted via telephone, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. We may require your name, email address, telephone number, or other information to verify your identity, as well as confirmation of whether you are a California resident or submitting this request on behalf of California resident (as an authorized agent). If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information. Only you, or a person authorized to act on your behalf, may make a request related to your personal information.

DO NOT TRACK 

We do not respond to Do Not Track requests. Do Not Track is a preference you can set in your web browser to inform websites and mobile applications that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser. 

INFORMATION SECURITY

We implement and maintain reasonable security measures to protect the personal information we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. These security measures include: secure configuration of assets, account management, access control management, vulnerability management, audit log review, malware defenses, network monitoring and defenses, a security awareness training program, and security incident response. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the personal information we have collected from you.  

PERSONAL INFORMATION OF CHILDREN 

24 Hour Fitness’ Career Page is not intended for use by individuals under the age of eighteen (18) years. If we learn that we have collected or received personal information from individuals under the age of eighteen (18), we will delete the personal information. If you believe we have personal information on individuals under the age of eighteen (18), please contact us at the contact information provided below.

CHANGES TO THIS PRIVACY NOTICE

This Privacy Notice is subject to change at any time. Changes to this Privacy Notice will be posted on this page and will indicate the date the changes go into effect. If we make any changes that materially affect your privacy rights, we will announce those changes by prominent post on the application website and obtain your consent, if required.
